Mediation of divorce and post-divorce modification matters is increasingly widely accepted in our Denver community. The Colorado courts favor mediation for family matters because it produces better agreements and preserves relationships. Mediation reduces conflict and allows for more control over the outcome. The courts generally require couples to mediate any areas of disagreement before the judge will hear the case. This is true whether or not the couple has retained legal counsel. Mediation helps to determine whether agreement can be voluntarily reached before the judge imposes a decision.
It is possible to divorce without attorneys and without a lengthy court battle when you mediate. Approximately 95% of our mediation clients attend mediation pro se (representing themselves). After reaching agreement, a Legal Review provision provides the opportunity to have your own attorney review the Memorandum of Understanding.
It is not unusual for each spouse to pay $10,000 to retain an attorney and have their case tied up in litigation for two years and longer. Our average mediation clients spend $1,000 -$1,250 each, saving 90% or more for the total cost of divorce, while completing the agreements and necessary paperwork in an average of 2 months time in preparation for the Initial Status Conference.
All court-required paperwork for a typical divorce can be completed in mediation or between sessions, beginning with the initial petition. We routinely address the division of debts and assets, parenting plans (also referred to as custody), child support, maintenance (also referred to as alimony), college provisions, and family-owned businesses.
Modifications to existing child support and parenting plans are efficiently and inexpensively addressed through mediation. The process is designed to preserve respect and goodwill between co-parents and their children, allowing the restructured family to enjoy the best environment possible in both homes.
